Section 70. Prerequisites to student instruction

13 AAC 25.070. Prerequisites to student instruction

Instruction in the operation of a motor vehicle may not be given to a student by a driver training school licensed under 13 AAC 25.010 - 13 AAC 25.190 unless

(1) each motor vehicle used for instruction is equipped with dual controls for foot brake and clutch, or foot brake only in a vehicle with an automatic transmission, and a rear-view mirror for use by the instructor, and has satisfactorily passed a vehicle inspection conducted by the department or a person designated by the department;

(2) the licensee has filed with the commissioner a certificate (SR-22) of liability insurance coverage which indicates that each motor vehicle used for instruction is insured by an insurance company authorized to do business in this state which covers the liability of the school, the driving instructor and any student taking instruction in an amount not less than that required by AS 28.20.440 . The commissioner will be notified at least 10 days before cancellation or expiration of a policy of insurance, and of each change in the motor vehicles covered;

(3) the student to be instructed has in his possession either a valid instruction permit issued under AS 28.15.051 (a) or a motor vehicle driver's license for the class of vehicle in which instruction is to be given;

(4) the person giving the instruction possesses a valid operator's license issued under 13 AAC 25.010 - 13 AAC 25.190;

(5) the course of instruction is approved by the state Department of Education and Early Development.
