Section 805. Eligible individuals

7 AAC 47.805. Eligible individuals

(a) An individual is eligible to receive assistance under 7 AAC 47.800 - 7 AAC 47.890 if the individual

(1) is a resident of this state; in this paragraph, "resident" has the meaning given in AS 47.25.430 (a);

(2) is 65 years of age or older;

(3) does not have income that exceeds the limit permitted by 7 AAC 47.810;

(4) does not have resources that exceed the amount permitted by 7 AAC 47.815; and

(5) meets the standards for not being a resident of certain institutions as specified in 7 AAC 47.822.

(b) Notwithstanding (a) of this section, the department will consider the following individuals to be eligible to receive assistance under 7 AAC 47.800 - 7 AAC 47.890:

(1) an individual who is 65 years of age or older and is currently receiving assistance under AS 47.25.430 - 47.25.615;

(2) an individual who is 65 years of age or older and is currently receiving medical assistance as follows:

(A) as a qualified Medicare beneficiary eligible for assistance under

(i) AS 47.07; and

(ii) 42 U.S.C. 1396a or 42 U.S.C. 1396d;

(B) as a special low income Medicare beneficiary eligible for assistance under

(i) AS 47.07; and

(ii) 42 U.S.C. 1396a;

(C) as an individual who is eligible for adult public assistance under AS 47.25.430 - 47.25.615, but who declines cash payments and is eligible for Medicaid under AS 47.07.020 (b)(1).
