7 AAC 47.822. Non-institutional residency

(a) To be eligible for assistance, an applicant may not be a resident of

(1) a public institution, unless the same eligibility requirements as those in 7 AAC 40.385 for purposes of adult public assistance are satisfied;

(2) a nursing home, unless the same eligibility requirements as those in 7 AAC 40.385 for purposes of adult public assistance are satisfied;

(3) a correctional facility;

(4) an Alaska Pioneers' Home, unless the same eligibility requirements as those in 7 AAC 40.385 for purposes of adult public assistance are satisfied; or

(5) a public or private institution for mental disease, unless the same eligibility requirements as those in 7 AAC 40.385 for purposes of adult public assistance are satisfied.

(b) Assistance will be provided to an otherwise eligible applicant for the month in which the applicant is admitted to an institution listed in (a) of this section, or for the month in which the applicant is discharged, if the applicant resides outside of the institution for at least one day of the month.

(c) In this section, "public institution" does not include a publicly operated community residence under 20 C.F.R. 416.211(c).
