Section 507. Form of eligibility certification for upgrade and closure assistance

18 AAC 78.507. Form of eligibility certification for upgrade and closure assistance

(a) An owner or operator of a UST applying for a grant under AS 46.03.430 must submit an eligibility certification on a form supplied by the department.

(b) On the eligibility certification form, the owner or operator must list the

(1) facility name, location, and facility identification number;

(2) total assets of the operator of the UST, as of July 1, 1999, excluding the value of goodwill;

(3) total estimated costs of bringing USTs into compliance with state and federal laws, including the amounts already incurred if the work or financing of the work was not paid on or before July 1, 1999;

(4) total outstanding estimated costs associated with releases of petroleum from USTs, including the amounts already incurred if the work or financing of the work was not paid on or before July 1, 1999;

(5) total assets of the owner of the UST, as of July 1, 1999, unless the UST is owned by the state or a municipality;

(6) tangible net worth, as of July 1, 1999, of the operator;

(7) tangible net worth, as of July 1, 1999, of the owner, unless the owner is the state or a municipality.

(c) In order to be eligible for a grant under AS 46.30.430 , the owner or operator must certify that as of July 1, 1999, neither the operator nor the owner has a tangible net worth that exceeds $250,000 as reported under (b)(6) or (b)(7) of this section. If the owner is the state or a municipality, only the operator must provide a net worth certification.

(d) The net worth certification required by (c) of this section must be signed in the presence of a notary under oath and subject to penalty of perjury.

(e) General information about whether an applicant is qualified for assistance is not confidential. Detailed financial information submitted under this section is confidential under AS 46.03.440 .

(f) For purposes of this section, tangible net worth must be calculated according to the definition set out in AS 46.03.450 .
