7 AAC 49.010. Hearing; special provisions

(a) The provisions of this chapter apply to applicants for and recipients of financial, food, or medical assistance granted by the department in the General Relief Assistance (GRA), General Relief Medical (GRM), Chronic and Acute Medical Assistance (CAMA), adult public assistance (APA), Medicaid, Alaska Temporary Assistance Program (ATAP), food stamp, subsidized adoption, and heating assistance programs. The provisions of this chapter do not apply to food stamp and Alaska Temporary Assistance Program intentional program violation administrative disqualification hearings covered under 7 C.F.R. 273.16 and 7 AAC 45.585.

(b) Federal regulations relating to hearings within the Medicaid program under 42 C.F.R. 431.220 - 431.250 and the food stamp program under 7 C.F.R. 273.15 and 273.21(p) take precedence over the provisions of 7 AAC 49 with regard to hearings relating primarily to those programs.
