3 AAC 53.010. Applicability, purpose, and waiver

(a) The provisions of 3 AAC 53.010 - 3 AAC 53.140 apply to all local exchange carriers subject to economic regulation by the commission.

(b) The purpose of 3 AAC 53.010 - 3 AAC 53.140 is

(1) to implement AS 42.05.381 (e) by establishing a simplified rate filing procedure and a range or adjustment of local service rates; and

(2) to implement AS 42.05.381 (f) by establishing a procedure to adjust local service rates for changes in jurisdictional cost allocation factors.

(c) Unless otherwise mandated under AS 42.05, any requirement in 3 AAC 53.010 - 3 AAC 53.140 may be modified or waived, in whole or in part, by order of the commission upon application and a showing of good cause or on the commission's own motion in accordance with the provisions of 3 AAC 48.805.
