3 AAC 52.900. Application and purpose

(a) The provisions of 3 AAC 52.900 - 3 AAC 52.940 apply to all utilities included in the definition of "public utility" in AS 42.05.990 .

(b) The purpose of 3 AAC 52.900 - 3 AAC 52.940 is to establish a method for reasonable compensation for joint use if a utility owning a pole and another utility fail to agree on compensation for joint use of the pole. An agreement for joint use must be filed with the commission. Absent unusual circumstances, the commission will assert its authority over joint use only if the utilities disagree on the terms of joint use or a joint use agreement, or if the commission has reason to believe that the utilities are not acting in accordance with the intent of AS 42.05.
