22 AAC 20.285. Purpose of rescission hearings and applicable procedures

The purpose of a rescission hearing is to determine if a change in circumstances or new information in a prisoner's case warrants a conclusion by the board that an earlier decision to release the prisoner on discretionary parole is inconsistent with AS 33.16.100 , and thus should be rescinded. A parole rescission hearing is governed by the procedures set out in 22 AAC 20.095 - 22 AAC 20.100, 22 AAC 20.125, 22 AAC 20.150(h) and (j)-(o), 22 AAC 20.165(a) -(c) and (e)-(g), and 22 AAC 20.325 - 22 AAC 20.330.
