Section 100. Appearance by witnesses at hearings

22 AAC 20.100. Appearance by witnesses at hearings

(a) Any interested person, agency, or group may submit written information regarding any prisoner or parolee appearing before the board.

(b) Except as set out in 22 AAC 20.105, the board will not permit the appearance of witnesses at discretionary parole hearings, parole rescission hearings, or special medical parole hearings. The board may make a rare exception due to exigent circumstances.

(c) The board will permit the appearance of witnesses with relevant testimony called by the parolee or by the state at a parole revocation hearing.

(d) Before a witness testifies, the board may request a parolee or the parolee's attorney to make an offer of proof of the statements to be made by the witness if the witness testifies before the board. The board may

(1) accept the offer of proof without having the witness physically appear and testify at the hearing; or

(2) require the testimony to be presented.
