20 AAC 05.790. Point system for the Southeastern Alaska shrimp otter trawl fishery

(a) Past participation. The commission will award a maximum of 18 points to an applicant for past participation in the Southeastern Alaska shrimp otter trawl fishery. An applicant who commercially harvested shrimp with otter trawl gear during the period 1993 - 1996 will be awarded points for the years in which the applicant participated as a gear operator based on the following:

    

    

1996 400 pounds or more 12 Less than 400 pounds 8 1995 400 pounds or more 9 Less than 400 pounds 6 1994 400 pounds or more 6 Less than 400 pounds 4 1993 400 pounds or more 3 Less than 400 pounds 2

(b) There is a rebuttable presumption that an applicant was a crewmember and not a gear operator for a year if the applicant's commercial harvest was less than 35 percent of the total commercial harvest taken in the fishery and delivered from the vessel during that year. The presumption can be rebutted with a preponderance of evidence showing that the applicant was the sole gear operator on the vessel at the time the shrimp were harvested or that the applicant was a partner with one or more other gear operators on the vessel.

(c) Consistent participation. The commission will award a maximum of 18 points to an applicant for consistent participation. The points awarded will be based on the number of statistical weeks of the year that the applicant commercially harvested shrimp in the fishery as a gear operator according to the following:

(d) Economic Dependence. An applicant will be awarded a maximum of three points if the applicant owned as of January 1, 1997, a vessel that the applicant used or intended to use in the fishery.
