(a) Past participation. The commission will award a maximum of 12 points to an applicant for past participation in the Southeastern Alaska shrimp beam trawl fishery. An applicant who commercially harvested shrimp with beam trawl gear during the period 1993 - 1996 will be awarded points for the years in which the applicant participated as a gear operator based on the following:
1996 2000 pounds or more 6 Less than 2000 pounds 3 1995 2000 pounds or more 6 Less than 2000 pounds 3 1994 2000 pounds or more 4 Less than 2000 pounds 2 1993 2000 pounds or more 2 Less than 2000 pounds 1
(b) There is a rebuttable presumption that an applicant was a crewmember and not a gear operator for a year if the applicant's commercial harvest was less than 35 percent of the total commercial harvest taken in the fishery and delivered from the vessel during that year. The presumption can be rebutted with a preponderance of evidence showing that the applicant was the sole gear operator on the vessel at the time the shrimp were harvested or that the applicant was a partner with one or more other gear operators on the vessel.
(c) Consistent participation. The commission will award a maximum of 30 points to an applicant for consistent participation. The points awarded will be based on the number of statistical weeks of the year that the applicant commercially harvested shrimp in the fishery as a gear operator according to the following:
1996 7 weeks or more 15 2 weeks to 6 weeks 6 Less than 2 weeks 0 1995 10 weeks or more 15 2 weeks to 9 weeks 6 Less than 2 weeks 0 1994 10 weeks or more 10 3 weeks to 9 weeks 4 Less than 3 weeks 0 1993 7 weeks or more 5 3 weeks to 6 weeks 2 Less than 3 weeks 0
(d) Economic Dependence. An applicant will be awarded a maximum of four points if the applicant owned as of January 1, 1997, a vessel that the applicant used or intended to use in the fishery.
