Section 650. Wait-list procedures

17 AAC 42.650. Wait-list procedures

(a) If the number of available tiedown spaces in a category is not sufficient to meet demand, the airport manager shall establish and maintain in chronological order according to date of request a wait list of each person who has submitted a written request for a tiedown space in that category under (b) of this section. A wait list must include each person's name, mailing address, date of request, and, if available, telephone and facsimile numbers and electronic mail address. A wait list is a public record.

(b) To be added to a wait list, a person must submit a written request for a tiedown space. The request must include the person's name, mailing address, date of request, and, if available, telephone and facsimile numbers and electronic mail address.

(c) When a tiedown space becomes available and is not reassigned through the switch-list procedures of 17 AAC 42.640, the airport manager shall mail or deliver by hand a notice that a space is available, along with an application for a tiedown permit for that space, to the first person in chronological order on the applicable wait list.

(d) To accept an offered permit under this section, a person must

(1) submit a completed tiedown permit application that includes all the information required under 17 AAC 42.610 (b) within 30 days after the date that the airport manager mails or delivers the offer to the person; and

(2) satisfy all applicable requirements for a permit under 17 AAC 42.610 at the time that the person accepts the permit.

(e) The airport manager shall remove a person's name from the applicable wait list 30 days after the date the manager mails or delivers an offer of a permit to the person if the person

(1) accepts the offer as provided under (d) of this section;

(2) rejects the offer; or

(3) does not respond to the offer.

(f) If the first person on the applicable wait list does not timely accept the offer of a permit, the airport manager shall offer the tiedown space to the next person on that list.

(g) If the airport manager determines that requiring confirmation of a person's desire to remain on a wait list will expedite the issuance of tiedown permits for a category of space, the manager shall request at least the first five persons on the applicable wait list to confirm that desire. The manager's request for confirmation must be in writing. If the manager does not receive confirmation from a person within 30 days after the date that the airport manager mails or delivers the request, the manager shall remove the person's name from the applicable wait list.

(h) The airport manager shall mail or deliver to the person notice that the person's name has been removed from a wait list under this section.
