Section 635. Limitation on number of permits within a tiedown category

17 AAC 42.635. Limitation on number of permits within a tiedown category

(a) The airport manager shall limit the number of permits that a permittee may hold for a tiedown category to one when, considering the number of spaces in that category and the demand for those spaces, the manager determines it is in the best interest of the state to do so.

(b) The airport manager shall notify the public in accordance with 17 AAC 42.400 of the manager's determination under (a) of this section. The notice must identify the affected tiedown category and state the effective date on which the manager's decision to limit the number of permits will take effect. The manager shall mail or deliver a copy of the notice to each permittee in the affected category. If a wait list exists for the affected category, the manager shall also mail or deliver a copy of the notice to each person on that wait list.

(c) An airport manager's decision to limit the number of permits a permittee may hold in a tiedown category under (a) of this section does not apply to a permittee who holds more than one permit in that category at the time the manager's decision takes effect. A permittee who holds more than one permit in the category at the time the manager's decision takes effect may continue to hold the permits and obtain subsequent permits so long as the permittee otherwise continues to qualify for the permits under 17 AAC 42.600 - 17 AAC 42.699.

(d) A limitation the airport manager implements under (a) of this section does not apply after the manager determines that it is no longer in the best interest of the state to apply the limit. The manager shall notify the public in accordance with 17 AAC 42.400 of the manager's determination. The notice must identify the affected tiedown category and state the date that the limitation will no longer apply. The manager shall mail or deliver a copy of the notice to each permittee in the affected category. If a wait list exists for the affected category, the manager shall also mail or deliver a copy of the notice to each person on that wait list.
