17 AAC 42.220. Lease, permit, concession, or other interest term limitations

(a) The maximum period for the term of a lease, permit, concession, or other interest, including extensions and periods of holdover, relating to an airport is 55 years.

(b) Before the airport manager approves or extends the term of a lease, permit, concession, or other interest for an auxiliary or nonaviation use of a premises that the manager has determined in writing will be needed for an aviation use or for airport development in the future, the manager shall first estimate when the premises will likely be needed for aviation use or airport development. A term or a term extension for an auxiliary or nonaviation use of those premises may not run beyond the time that the manager estimates the premises will become needed for an aviation use or for airport development.
