Section 170. Period of suspension

13 AAC 25.170. Period of suspension

(a) The department will, in its discretion, suspend a school or instructor's license for any period which does not exceed one year, except where a specific period is required by this section.

(b) The period of suspension for certain offenses is as follows:

(1) conviction of driving while under the influence of liquor or drugs, reckless driving, racing or leaving scene of accident

(A) 90 days first conviction;

(B) one year second conviction;

(C) three years third conviction;

(2) accumulation of 12 points during any 12 consecutive months or 18 points during any 24 consecutive months for conviction of traffic offenses other than those listed under (b)(1) of this section

(A) 30 days first accumulation;

(B) six months second accumulation;

(C) three years third accumulation;

(3) violation of 13 AAC 25.080 - 13 AAC 25.140 shall result in not less than 30-day suspension;

(4) conviction of fraud or fraudulent practice shall result in not less than six months' suspension.

(c) At the end of the period of suspension, the license shall be returned to the licensee provided there is at that time no cause which precludes the return of the license.
