Section 905. Reinstatement of a lapsed license endorsement

12 AAC 48.905. Reinstatement of a lapsed license endorsement

(a) The board will reinstate a pharmaceutical agent prescription and use license endorsement that has been lapsed less than two years if the applicant for reinstatement submits

(1) the required fees established in 12 AAC 02.105 and 12 AAC 02.300; and

(2) documentation that the applicant has met the continuing education requirements in 12 AAC 48.210(d) .

(b) The board will reinstate a pharmaceutical agent prescription and use license endorsement that has been lapsed for two years but less than five years if the applicant for reinstatement submits

(1) the required fees established in 12 AAC 02.105 and 12 AAC 02.300 for the entire period that the endorsement has been lapsed; and

(2) documentation that the applicant

(A) has met the continuing education requirements in 12 AAC 48.210(d) that would have been required to maintain a current endorsement for the entire period that the endorsement has been lapsed; and

(B) completed 12 contact hours of continuing education approved by the board in ocular pathology or pharmacology during the six months immediately before the date that the applicant applied for reinstatement of the endorsement; hours documented under this subparagraph must be taken in addition to those hours documented under (A) of this paragraph.

(c) The board will reinstate a pharmaceutical agent prescription and use license endorsement that has been lapsed for five years or more if the applicant for reinstatement submits

(1) the fees that would have been required to maintain a current license endorsement for the last two full license periods and the current license period; and

(2) documentation that the applicant has

(A) met the continuing education requirements in 12 AAC 48.210(d) that would have been required to maintain a current endorsement for the last two full license periods and the current license period; and

(B) completed 12 contact hours of continuing education approved by the board in ocular pathology or pharmacology during the six months immediately before the date that the applicant applied for reinstatement of the endorsement; hours documented under this subparagraph must be taken in addition to those hours documented under (A) of this paragraph.

(d) If the board accepts an applicant's hours of continuing education to reinstate a pharmaceutical agent prescription and use license endorsement, the applicant may not use the same hours to meet the continuing education requirements for a subsequent renewal of the endorsement.
