Section 830. Unit approval

11 AAC 84.830. Unit approval

(a) Within 60 days after the close of the public comment period required by 11 AAC 84.825, the commissioner will issue a written decision, approving or disapproving the unit agreement, in which he states the basis for his decision after considering the provisions of 11 AAC 84.815.

(b) If the commissioner determines that the provisions of 11 AAC 84.815 are not met, the commissioner will, in his discretion, propose modifications which, if accepted by the parties to the proposed unit agreement, would qualify the agreement for approval.

(c) No unit will be approved unless parties to the unit agreement hold sufficient interests in the unit area to give reasonably effective control of operations.
