Section 215. Facility payments

7 AAC 43.215. Facility payments

(a) Payment will be made by the division in accordance with 7 AAC 43.670 - 7 AAC 43.709.

(b) Partial payment may be made to a facility upon request. Partial payment may be made monthly in an amount not to exceed 80 percent of the average monthly billing for the previous state fiscal quarter.

(c) A recipient's income is a prior resource. Therefore, in situations where a recipient remains in a facility for a period of less than a full month, the recipient's income for the month, after subtracting all allowable deductions, must be divided by the number of days in the month and that daily amount applied to those days that the recipient was in the facility.

(d) The regional office of the division will promptly notify the facility of any known credit amounts available to a recipient and sources of those credits. A recipient's income, exclusive of the authorized allowance for personal incidental needs, must be offset as a credit against the established daily rate. Credit amounts which become known to the facility must be reported to the regional office. The facility is responsible for collecting those credit amounts; however, the regional office will attempt to render assistance in collection when requested by the facility.
