7 AAC 40.410. Joint assistance households

(a) If an applicant appears to be eligible for assistance under both this chapter and AS 47.25.310 - 47.25.420 or successor program's statutes, the division will inform the applicant of each program. The applicant must choose the program in which to participate. If an applicant who receives assistance under AS 47.25.310 - 47.25.420 or successor program's statutes chooses to receive assistance under this chapter, assistance under this chapter begins with the month that the applicant receives an SSI or Social Security Disability Insurance payment or the month that the division determines the applicant to be otherwise eligible for assistance under this chapter, whichever occurs earlier.

(b) Notwithstanding any other provision of this chapter, an applicant need not apply for SSI if doing so would result in termination of eligibility for assistance under AS 47.25.310 - 47.25.420 within the family unit.
