Section 390. Nursing home and hospital payments

7 AAC 40.390. Nursing home and hospital payments

(a) An eligible applicant who is eligible for SSI and who is a patient in a nursing home or hospital under 7 AAC 43 may receive a monthly payment for incidental personal needs from the Social Security Administration in accordance with 20 C.F.R. 416.414. An additional payment will be made under this chapter, if necessary, to provide a total of $75 per calendar month for incidental personal needs.

(b) An eligible applicant whose income exceeds SSI income standards who is a patient in a nursing home or hospital under 7 AAC 43 may retain $75 per calendar month for incidental personal needs, in accordance with 7 AAC 43.250.

(c) Subsections (a) and (b) in this section apply in any month in which the applicant resides in a hospital or nursing home continuously for the entire calendar month; provided, however, that an absence for not more than 14 consecutive days which does not give rise to discharge and readmission does not preclude continuous residency under this subsection.

(d) For purposes of this section "patient" does not include a recipient who is eligible for payments under 7 AAC 40.385.
