Section 380. Payments

7 AAC 40.380. Payments

(a) Payment for assistance under this chapter to an eligible applicant who meets the eligibility requirements under this chapter, including, if applicable, eligibility for SSI benefits, on the date that a district office of the division receives the applicant's identifiable application as described in 7 AAC 40.070(a) begins on the date that the identifiable application is received by the division.

(b) Unless an applicant is eligible for payment under (a) of this section, payment for assistance under this chapter to an eligible applicant who is also eligible for SSI begins on the first day of the month after the Social Security Administration issues written notification to the applicant that SSI benefits are approved.

(c) Unless an applicant is eligible for payment under (a) of this section, payment for assistance under this chapter to an eligible applicant who is not also eligible for SSI begins on the earliest of the following dates:

(1) the first day of the month after the Social Security Administration issues written notification to the applicant that Social Security benefits provided under 42 U.S.C. 401 - 433 (Title II of the Social Security Act) are approved;

(2) the first day of the month after the division of vocational rehabilitation of the Department of Labor and Workforce Development issues written notification to the division that the applicant meets the definition of disability in 42 U.S.C. l382c(a)(3) (Title XVI of the Social Security Act).

(d) If the beginning date of assistance to an applicant described in (a) of this section is not the first day of the month, the division will prorate the first month's payment. To prorate, the division will calculate and round the payment as if the applicant were entitled to a full month's benefit and will then multiply the full month's payment amount by the number of days remaining in the month, including the day determined under (a) of this section, and divide the product by the total number of days in the month.

(e) In calculating the payment amount under (d) of this section, the division will carry cents throughout the calculation, but will round down from $.99 in establishing the payment.

(f) Assistance payments are made on a monthly basis, by state warrant or by means of electronic transfer of money to the financial account designated by the recipient or to the recipient's electronic benefit transfer (EBT) account with the state's financial EBT agent.

(g) Assistance payments are made without any restrictions on how they may be used.

(h) Notwithstanding (c) of this section, payment for assistance under this chapter to an eligible applicant who applied for assistance before July 1, 2004, and who either is not also eligible for SSI or, although eligible for SSI, did not receive interim assistance under 7 AAC 40.375, begins on the latest of the following dates:

(1) date that a district office of the division receives the applicant's identifiable application as described in 7 AAC 40.070(a) ;

(2) the date that the applicant first meets the eligibility requirements under this chapter; or

(3) if applicable, the date of the beginning of SSI payment.
