Section 60. Denial, suspension, or revocation

7 AAC 29.060. Denial, suspension, or revocation

(a) If the department determines that a facility or program does not comply with this chapter, the department will deny, suspend, or revoke a certificate issued under this chapter. If JCAHO or CARF denies, suspends, or revokes a certification described in 7 AAC 29.010(b) , and if the department does not certify that facility or program under this chapter, that denial, suspension, or revocation will be considered a denial, suspension, or revocation under this section.

(b) The department will initiate proceedings under (a) of this section, by service of an accusation or statement of issues in accordance with AS 44.62. The department will conduct those proceedings in accordance with AS 44.62.330 - 44.62.650. If the health, safety, or well-being of a client is not in jeopardy, the department action takes effect upon the department's final administrative decision. If the health, safety, or well-being of any client is in jeopardy, the denial, suspension, or revocation of the certificate is effective immediately upon the issuance of a written notice by the department.

(c) If a certificate is denied or revoked, the length of time before a facility or program may reapply, if any, will be stated in the department's final decision.
