Section 10. Application of standards

7 AAC 29.010. Application of standards

(a) The provisions of this chapter apply to a substance abuse treatment facility or program seeking certification in this state unless a provision is waived by the department under 7 AAC 29.050, or the facility or program is exempt under (b) or (c) of this section.

(b) Except as provided in 7 AAC 29.040(b) , a substance abuse treatment facility or program that has a current certification from the Joint Commission on Accreditation of Healthcare Organizations or the Commission on Accreditation of Rehabilitation Facilities (CARF) is exempt from the requirements of this chapter. The facility or program shall

(1) submit to the department a copy of its current certification, and any renewal of that certification; and

(2) notify the department immediately if its certification is not renewed or is suspended or revoked by JCACHO or CARF, and include with the notification its request for certification by the department under this chapter.

(c) A substance abuse treatment facility or program operated by the federal government is exempt from the requirements of this chapter.
