Section 431. Notice of administrative review

4 AAC 65.431. Notice of administrative review

(a) A family or provider that is aggrieved by a grantee's written determination made under this chapter may request an administrative review of the grantee's determination by submitting a notice of administrative review in writing to the child care program office. The notice of administrative review must be postmarked no later than 15 working days after receipt of the grantee's written determination.

(b) The notice of administrative review must contain

(1) a copy of the written determination being requested for administrative review;

(2) an itemized list of each alleged violation of statutes or regulation upon which the notice of administrative review is based;

(3) factual arguments supporting the allegation of the aggrieved party; and

(4) the specific relief sought.

(c) The notice of administrative review must be signed by the aggrieved party or its authorized representative requesting the review.

(d) A determination by a grantee that would result in the termination of previously authorized financing shall be stayed pending the outcome of the administrative review, unless the grantee's determination is based upon substantial evidence of threat or harm to a child in care.
