Section 777. Students that have passed another state's competency examination

4 AAC 06.777. Students that have passed another state's competency examination

(a) A student may qualify for a diploma without passing the HSGQE if the student has passed another state's competency examination as provided in AS 14.03.075 (c)(2) and meets the requirements of this section.

(b) In order to award a student a diploma under AS 14.03.075 (c)(2), a governing body shall

(1) determine that the student has satisfied 4 AAC 06.075 and all graduation requirements of the governing body;

(2) determine that the examination the student passed in the other state

(A) was a statewide examination;

(B) tested reading, English, and mathematics; and

(C) was a requirement to receive a secondary school diploma.

(c) To qualify for a diploma under this section, the student must submit a complete application to the governing body on a form prescribed by the department. The student must submit with the application documentation from the state where the student took and passed the competency examination. The documentation must consist of the address of the school where the student took and passed the examination, and either of the following:

(1) a student assessment report from the school where the student passed the competency examination; the report must

(A) be transmitted directly to the governing body in this state from the school where the student passed the examination; and

(B) contain a summary of the student's assessment history in the school issuing the report;

(2) the student's transcript from the school where the student passed the competency examination; the transcript must

(A) be transmitted directly to the governing body in this state from the school where the student passed the examination; and

(B) show the subtests of the competency examination and the subtests that the student has passed.

(d) If the documentation required by (c) of this section was provided when the student enrolled in the public school system in this state, and if the information was transmitted in a manner consistent with (c) of this section, the student is not required to provide the documentation again with the application.

(e) The student shall take the HSGQE as provided in 4 AAC 06.755 until the

(1) student passes the HSGQE; or

(2) governing body grants the application to receive a diploma without passing the HSGQE.

(f) The student may submit an application under this section at any time after enrolling in the public school system in this state. The governing body may deliberate and take action on the application at any time after the student submits the application.

(g) The governing body's decision approving or denying the request under this section must be in writing and shall be delivered by registered mail. The governing body may deliver courtesy copies to the student or the student's parents or legal guardian by other methods. The governing body shall provide a copy of the decision to the department. The governing body shall state the reason for its decision in the written decision. A denial of a request under this section may be appealed to the department as provided in 4 AAC 06.780. The governing body's written decision and notice must include a statement that the decision may be appealed to the department as provided in 4 AAC 06.780.
