Section 950. Confidentiality

3 AAC 233.950. Confidentiality

(a) The foundation will maintain the confidentiality of material in a proposal that the applicant identifies as a trade secret or proprietary information, unless

(1) the board determines that the identified material is not a trade secret or propriety information; or

(2) the applicant subsequently specifies in writing that the material may be released to the public.

(b) If a BIDCO that receives assistance under AS 37.17.200 - AS 37.17.390 identifies information that the BIDCO submits to the foundation as a trade secret or proprietary information, consistence with AS 37.17.090 (f) and AS 37.17.350 , except to the extent that the board determines the information not to be a trade secret or proprietary information.

(c) The board will, in its discretion, and consistent with AS 37.17.090 (f), treat information submitted under AS 37.17.090 (f) confidentiality.

(d) The board will meet at least twice a year to consider confidentiality issues that arise in the interim.
