Section 150. Disputes and appeals

3 AAC 155.150. Disputes and appeals

(a) Any dispute concerning a question of fact or interpretation of policy under this chapter will be decided by the department's director of administrative services for the unincorporated community capital project matching grant program. The director of administrative services shall document in writing a decision made under this subsection and shall furnish that document to the affected unincorporated community.

(b) The affected unincorporated community may appeal the decision of the director of administrative services by submitting, within 30 days from the date of receipt of the director's decision, a written appeal to the commissioner of the department. The commissioner shall make a decision on the dispute and transmit the decision in writing to the unincorporated community. The commissioner's decision on the matter is final.

(c) Pending a final decision on a dispute under (a) or (b) of this section, the affected unincorporated community shall proceed with performance of the grant in accordance with the director's decision.
