3 AAC 155.090. Site control

An unincorporated community shall demonstrate to the department that it has site control for capital projects, facilities, and other forms of property that are built, acquired, or used in capital projects for which an appropriation was made under AS 37.06.020 (f). If the project involves the occupancy or use of real property, the unincorporated community receiving the appropriation for the capital project must demonstrate to the department that the unincorporated community has the legal right to access, occupy, and use the real property, unless a waiver from the requirements of site control has been requested by the unincorporated community and approved by the department.
