Section 102. Appeal of determination to the commissioner

3 AAC 130.102. Appeal of determination to the commissioner

(a) An applicant may appeal to the commissioner a determination of the applicant's millage rate equivalent and data elements made under 3 AAC 130.097. The appeal must be in writing and must be postmarked within 30 days after the applicant receives the determination under 3 AAC 130.097. The appeal must include the relevant evidence in support of the applicant's claim.

(b) No later than 30 days after receipt of the appeal, the commissioner will decide the appeal. Immediately following the commissioner's decision, written notification, containing the decision and the reasons for it, will be sent to the applicant.

(c) If an applicant does not appeal a determination made under 19 AAC 30.097 within the time specified in (a) of this section, the millage rate equivalent and data element determinations constitute the final determination of the department.
