3 AAC 26.660. Exceptions to notice and opt out requirements for service providers and joint marketing

(a) A licensee is not subject to the requirements in 3 AAC 26.625 and 3 AAC 26.645 if the licensee provides nonpublic personal financial information to a nonaffiliated third party to act as a service provider or to perform joint marketing services for the licensee or on behalf of the licensee, if the licensee

(1) has provided the initial notice as required under 3 AAC 26.610; and

(2) enters into a contractual agreement with the nonaffiliated third party that prohibits the nonaffiliated third party from disclosing or using the information, including using the information under an exception in 3 AAC 26.665 or 3 AAC 26.670, other than to carry out the purpose for which the licensee disclosed the information.

(b) In this section,

(1) "joint marketing services" means marketing the licensee's own products or services or marketing financial products or services offered under a joint agreement;

(2) "joint agreement" means a written contract under which a licensee and one or more financial institutions offer, endorse, or sponsor a financial product or service.
