Section 190. Procedures applicable to special reviews

22 AAC 20.190. Procedures applicable to special reviews

(a) Unless the board determines that an extreme emergency exists, a request for a special review must be received in the board office no later than eight weeks before the week of the next regularly scheduled board hearing at the facility where the prisoner is incarcerated.

(b) The prisoner must make application to the board and state specifically why the prisoner believes that the prisoner qualifies for a special review. The request must be sent through the prisoner's institutional parole officer if the prisoner is incarcerated in a state correctional facility. The request must be provided directly to the assigned parole officer if the prisoner resides in a contract correctional facility, and the supervising parole officer for the contract facility shall provide the documentation to the board.

(c) The board will make its decision in the same manner as provided for in 22 AAC 20.170. The board will notify the prisoner and the department of its decision. Any decision available to the board under 22 AAC 20.145 may be made. Granting of a special review will result in the prisoner's case being reviewed at the hearing date designated by the board.
