Section 20. Exemptions

18 AAC 85.020. Exemptions

The following sources of ionizing radiation are exempt from the requirement of 18 AAC 85.010:

(1) radioactive materials and products containing radioactive materials subject to regulations by the United States Atomic Energy Commission;

(2) source material in any chemical mixture, compound, solution, or alloy in which the source material is by weight less than 0.05 percent of the mixture, compound, solution, or alloy;

(3) unrefined and unprocessed ore containing source material;

(4) quantities of radioactive material listed in Table I; provided, that the possession or use of more than a total of 10 such scheduled quantities is not exempt;

Note 1: Many radioisotopes disintegrate into isotopes which are also radioactive. In expressing the concentrations in Table II, the activity stated is that of the parent isotope and takes into account the presence of the daughters.

Note 2: For a combination of isotopes, the limit for the combination should be derived as follows: Determine for each isotope in the combination the ratio between its concentration in the product and the exempt concentration. The sum of such ratios may not exceed unity.

(6) hands or dials of timepieces and other instruments containing luminous radioactive material, provided that persons who apply luminous radioactive material to hands or dials of timepieces and instruments are not exempt;

(7) domestic television receivers, providing the dose rate at five centimeters from any outer surface is less than 0.5 millirem per hour;

(8) electrical equipment, except domestic television receivers, that emits radiation incidental to its operation for other purposes, provided the dose rate to the whole body at the point of nearest approach to such equipment when any external shielding is removed does not exceed 0.5 rem per year. (Electrical equipment used for teaching purposes must also comply with sec. 200 of this chapter); and

(9) ionizing radiation-producing machines while in storage or transit. This exemption does not apply to demonstrating or functional testing of such equipment.
