Section 685. Department approval of onsite inspectors

18 AAC 80.685. Department approval of onsite inspectors

(a) The department will use the information provided by an applicant in this section to approve an onsite inspector required under 18 AAC 80.620(d) .

(b) An employee of a public water system may not conduct the annual onsite inspection of that water system required by 18 AAC 80.620(c) (5).

(c) An individual seeking department approval to perform onsite inspections of public water systems must

(1) demonstrate a sound understanding of public health principles, waterborne diseases, and the requirements of this chapter;

(2) provide documentation of that individual's qualifications; and

(3) provide documentation that the applicant has the experience and training to provide an annual report as specified in 18 AAC 80.620(d) .

(d) An individual who does not meet the requirements in (c) of this section may apply for approval to conduct onsite inspections. The department will review and approve or disapprove an application submitted under this subsection if

(1) the applicant's specific background demonstrates the applicant's competency to conduct the inspections and prepare the reports required by 18 AAC 80.620(d) ;

(2) the applicant pays the fee required by 18 AAC 80.1910(b)(7); and

(3) the applicant successfully completes a department-approved sanitary survey training course; if a department-approved course is not available in the state, the department will approve onsite inspectors under this subsection until appropriate training is offered.

(e) The department will approve a training course for individuals seeking to become onsite inspectors under (d) of this section if the content of the course covers standard sanitary engineering practices and principles at a depth that the department determines will adequately protect public health.

(f) An approval under this section is valid for two years. If the department finds that the performance of an onsite inspector is deficient or negligent, the department will revoke that inspector's approval.

(g) A person aggrieved by a decision under this section may request a hearing under 18 AAC 80.1920. This section does not affect a person's rights under AS 44.62 (Administrative Procedure Act).
