Section 625. Public hearing on filtration determination

18 AAC 80.625. Public hearing on filtration determination

(a) If the department determines that a public water system must install filtration, the department will issue a notice of the department's determination to the owner or operator of the system and will publish notice of the department's determination in a newspaper of general circulation. In the public notice, the department will

(1) describe the reasons for the determination and indicate the date by which filtration must be installed; and

(2) state that the department will hold a public hearing if the owner or operator of the system requests a hearing or if sufficient public interest is shown.

(b) A request for a public hearing under this section must be submitted in writing to the department within 10 days after publication of notice under (a) of this section. The request must describe the requestor's interests and the aspect of the determination that is requested to be heard. If the department grants a request for public hearing, the department will publish notice of the date, time, and place of the hearing at least 10 days before the hearing.

(c) A hearing under this section does not stay the department's determination. The only aspects of the department's determination that will be heard are

(1) whether the department has correctly determined that filtration is required; and

(2) whether the department has provided reasonable time within which the owner or operator of the public water system must install filtration.
