(a) The requirements of 40 C.F.R. 142.40 - 142.46, adopted by reference in 18 AAC 80.010(a) , apply to the department's issuance of a variance to a public water system.
(b) To request a variance, the owner must
(1) submit on a form provided by the department a written application that includes the information described in 40 C.F.R. 142.41, adopted by reference in 18 AAC 80.010(a) ; and
(2) pay the applicable fee required in 18 AAC 80.1910(k).
(c) The owner must submit each variance or variance extension request on a separate application.
(d) As required in 18 AAC 80.1910(g), the owner shall reimburse the department for expenses related to publication required under 40 C.F.R. 142.44, adopted by reference in 18 AAC 80.010(a) .
