Section 230. Assistance for disadvantaged systems

18 AAC 76.230. Assistance for disadvantaged systems

(a) A disadvantaged system or a system that expects to become a disadvantaged system as a result of a proposed drinking water project may apply to the department for a loan subsidy at the time it submits its financial assistance application under 18 AAC 76.225.

(b) A system is considered disadvantaged if the entire area served or to be served by a drinking water system meets the affordability criteria established in the priority list process described in 18 AAC 76.220.

(c) The department may provide a subsidy to a disadvantaged system in the form of principal forgiveness, according to the procedures and criteria established in the priority list process in 18 AAC 76.220. As required by 42 U.S.C. 300j-12(b), the department will include in the intended use plan described in 18 AAC 76.220(a) procedures and criteria for a subsidy under this section, including affordability criteria.
