Section 100. Not-sealed tags

17 AAC 90.100. Not-sealed tags

(a) The director may exempt a device in a commercial establishment from the sealing requirements of AS 45.75.120 , if the commercial establishment keeps the weighing or measuring device on the premises solely for the purpose of consumer convenience in weighing bulk commodities, and the director determines that the device will not be used for a purpose for which the use of a sealed device is required.

(b) The owner or operator of a device that is exempt from sealing requirements under (a) of this section shall apply and maintain a tag on the device, prominently displaying the words: "Not sealed, unlawful to remove, not legal for use in trade".

(c) Until it has been tested and sealed by an inspector of the division, a device bearing a tag specified in (b) of this section is not sealed and is not certified as correct and its use is prohibited for

(1) the purpose of buying or selling;

(2) the purpose of weighing or measuring for hire or reward; or

(3) any other purpose for which the use of a sealed device is required.
