Section 400. Marine highway system procurement activities

17 AAC 70.400. Marine highway system procurement activities

(a) The following statutes are adopted by reference into this section for use by the Alaska Marine Highway System for its procurement activities relating to the repair, maintenance, and reconstruction of vessels, docking facilities, and passenger and vehicle transfer facilities:

(1) AS 36.30.100 - 36.30.190 (Competitive Sealed Bidding), as amended through 7/1/92;

(2) AS 36.30.200 - 36.30.270 (Competitive Sealed Proposals), as amended through 7/1/92;

(b) The following provisions of the Alaska Administrative Code are adopted by reference into this section for use by the Alaska Marine Highway System for its procurement activities relating to the repair, maintenance, and reconstruction of vessels, docking facilities, and passenger and vehicle transfer facilities:

(12) 2 AAC 12.720 - 2 AAC 12.740 and 2 AAC 12.760 through 2 AAC 12.920 (Miscellaneous Provisions), as amended through 6/19/92; and

(13) 2 AAC 12.990 (Definitions), as amended through 6/19/92.

(c) In administering Alaska Marine Highway System procurements under the statutes and regulations incorporated by reference in this section,

(1) the cited regulations augment and supplement the cited statutes;

(2) in cases of conflicts between the cited statutes and the cited regulations, the cited statutes take precedence over the cited regulations; and

(3) all references to the commissioner of administration in the cited statutes and regulations mean the commissioner of transportation and public facilities.

(d) Repealed 12/23/93.
