Section 220. Refunds and cancellation penalties

17 AAC 70.220. Refunds and cancellation penalties

(a) Subject to the restrictions and cancellation penalties set out in (b) and (c) of this section, a passage ticket for passenger or vehicle deck space or a stateroom or berth ticket will be refunded as follows:

(1) an unused ticket will be refunded at full purchase price upon request and presentation of the ticket;

(2) a ticket that is only partly used because of a change in destination, number of persons ticketed, size of vehicle or stateroom or berth accommodations, or another factor, will be refunded on a pro rate basis upon request and presentation of the ticket; and

(3) a loss ticket will, in the discretion of the Alaska Marine Highway System, be refunded at full purchase price upon application and certification of loss on a form provided by the system.

(b) The Alaska Marine Highway System will, in its discretion, restrict ticket refunds as follows:

(1) a refund will be refused after a period of one year from the date of travel on the ticket;

(2) a refund will be refused to a person who cannot provide identification proving that he or she is the legal owner of the ticket;

(3) a refund will be refused to an individual if the original purchase of the ticket was made by a state or other government Transportation Request or "TR," and such a ticket will only be refunded upon application by the appropriate government office;

(4) a refund of a ticket purchased by check will be refused until at least 30 days after the date of ticket purchase;

(5) a refund of a ticket originally sold by an agent other than an employee of the Alaska Marine Highway System will be refused and referred to the agent who sold the ticket; and

(6) a refund for a partly used berth or stateroom ticket will be refused.

(c) Unless a request for a refund is made 14 or more days before the departure of a vessel, as posted in the Alaska Marine Highway schedule, a cancellation penalty of 10 percent or $10.00, whichever is greater, will be deducted from the refund. The Alaska Marine Highway System will, in its discretion, waive this cancellation penalty for a refund requested as a result of a ferry cancellation, or a sailing that is more than 12 hours late according to the departure time posted in the Alaska Marine Highway schedule.
