Section 130. Definitions

15 AAC 118.130. Definitions

In this chapter, unless the context requires otherwise, the definitions shall be as follows:

(1) "applicant" means the person or entity seeking monetary assistance to finance or refinance a medical facility or proposed medical facility under AS 18.26 and these regulations;

(2) "executive director" means the executive director or acting executive director of the Alaska Medical Facility Authority;

(3) "lessee" means, for purposes of AS 18.26 and these regulations, a political subdivision or nonprofit corporation that leases medical facilities from the authority;

(4) "nonprofit corporation" means a corporation, no part of the net earnings of which inures to the benefit of any private shareholder or individual, which is in compliance with the provisions of AS 10.20, the Alaska Nonprofit Corporations Act, and which is an organization described in Section 501(c)(3) of the Internal Revenue Code (26 USC § 501(c)(3)); and

(5) "operator" or "proposed operator" means the applicant or, if other than the applicant, the person or entity responsible for the management, day-to-day operation and maintenance, and the development and implementation of long-range goals and objectives for the medical facility or proposed medical facility.
