Section 345. Release of information for criminal justice research

13 AAC 68.345. Release of information for criminal justice research

(a) A person may request, in aggregate form, criminal justice information maintained by the repository for the purpose of criminal justice research by providing to the repository

(1) the full name, mailing address, and telephone number of the requester;

(2) a description of the specific criminal justice information requested, and how it relates to the purpose of the research;

(3) a description of the qualifications of the requester, including

(A) educational background;

(B) past research experience; and

(C) the name, title, and telephone number of a person who may be contacted to verify that information;

(4) the full name, address, and telephone number of any other person participating in the research who will have access to the information requested;

(5) at the discretion of the repository, two sets of fingerprints for the requester and for a person identified under (4) of this subsection, for the purpose of conducting state and national criminal history background checks; and

(6) any other information necessary to determine the qualifications of the requester to conduct criminal justice research.

(b) If the repository determines that the requester is qualified to conduct criminal justice research, the repository may release criminal justice information under this section if the requester pays the fee established in 13 AAC 68.900 and signs an agreement to abide by the following conditions:

(1) disclosure of the information to a person or for a purpose not authorized in writing by the department is subject to civil and criminal penalties;

(2) the department has the right to fully monitor the research to assure compliance with the terms of the agreement;

(3) the department has the right to examine and verify all data generated by the research project, and if a material error or omission is found, to order that the data not be released or used for any purpose unless corrected; and

(4) any other conditions required by the department to assure the security of the information and the privacy of the individuals to whom the information relates.

(c) Release of information under this section is not subject to the requirements of AS 12.62.160 (c)(3).
