Section 160. Waiver of requirements

13 AAC 68.160. Waiver of requirements

The department will, in its discretion, waive a requirement described under 13 AAC 68.100 - 13 AAC 68.120 or 13 AAC 68.130 - 13 AAC 68.155 or extend a waiver for up to one year at a time for an agency that lacks the resources to comply with the requirement. A request for waiver or an extension of a waiver under this section must include a description and cost estimate of the resources needed to comply with the requirement. The department will refer to the Criminal Justice Information Advisory Board a request for an extension of a waiver and ask for a recommendation from the board. After reviewing a recommendation of the board, the department will, in its discretion, extend a waiver if the department finds the waiver is appropriate under the circumstance.
