Section 125. Voluntary submission and removal of fingerprints

13 AAC 68.125. Voluntary submission and removal of fingerprints

(a) A person may voluntarily submit a set of fingerprints to be included in AAFIS by submitting to the department payment of the fee established in 13 AAC 68.900 and,

(1) for a person's own fingerprints, valid picture identification issued by a government unit; or

(2) for the fingerprints of a person described in AS 44.41.025 (d)(2) or 44.41.025(d)(3), proof of identification of the parent, guardian, or conservator and of the person whose fingerprints are being submitted.

(b) A person authorized to request that person's fingerprints be removed from AAFIS under AS 44.41.025 (f) may submit to the repository a written request for removal and a set of fingerprints to verify the person's identity. In response to a request under this subsection the repository shall

(1) remove the fingerprints from AAFIS and return both sets of fingerprints to the requester or certify that the sets of fingerprints have been destroyed; or

(2) explain in writing the reason that the fingerprints will not be removed.

(c) A set of fingerprints voluntarily submitted under this section must be legible and must be submitted on a form and in a format provided or approved by the department.
