11 AAC 93.144. Departmental investigations

(a) Upon receipt of an application for a reservation of water, the commissioner will, in his or her discretion, investigate any aspect of the application, including the source of the water and other uses or demands for water within the area, to determine whether there is a possibility that the rights of prior appropriators or the public interest will be adversely affected by the proposed reservation.

(b) Failure of the applicant to cooperate in the investigation will result in the rejection of the application.
