Section 62. Search requests and reports

11 AAC 06.062. Search requests and reports

(a) To retrieve a UCC record, by the name of the debtor or by the file number of the initial financing statement, a person may

(1) electronically search, at a filing office, the index established under AS 45.29.519 ;

(2) electronically search the index established under AS 45.29.519 by accessing the department's internet website; or

(3) submit, in accordance with this section, a request to the filing office for a search under AS 45.29.523 of the index established under AS 45.29.519 .

(b) A search request under (a)(3) of this section must

(1) set out the name of the debtor to be searched and whether the debtor is an individual or an organization; a search request shall be processed using the name in the exact form that name is submitted;

(2) set out the name and address of the person to whom the search report is to be sent; and

(3) include the appropriate fee in accordance with 11 AAC 05.010(a) (15)(E) or (F).

(c) A search request under (a)(3) of this section may be delivered to the filing office by any of the means by which UCC records may be delivered to the filing office under 11 AAC 06.051(c) .

(d) If a filer requests a search under (a)(3) of this section at the time an initial financing statement is filed, the debtor name as set out on the form shall be searched if the form is accepted and the relevant search fee is also tendered. The requesting party must be the remitter of the initial financing statement, and the search request shall be treated as a search that would retrieve all active financing statements filed on or before the date the initial financing statement is filed.

(e) If a continuation is not timely filed with respect to a financing statement, the financing statement lapses on its scheduled lapse date, but shall continue to be reported on a search as an active filing. On the first anniversary of that lapse date, that financing statement shall be rendered inactive, so that it is no longer reported on a search.
