11 AAC 04.080. Administrative fee

(a) The division will charge an administrative fee of $75 per day, beginning on the first day after the division provides notice to the lessee, for

(1) each original royalty report not received by the division by the designated date due;

(2) each original royalty report that is received by the designated due date, but that does not contain all documentation and information as required under 11 AAC 04.040;

(3) revisions to a royalty report resulting form settlements, lease administrative actions, or royalty accounting reconciliations, and not filed within 30 days after issuance of the notice that a revision is required or by the date required in a settlement agreement;

(4) failure to complete, on or before the implementation deadline as specified in writing by the commissioner, an agreement with the division to file royalty reports by approved electronic commerce method; and

(5) failure to make royalty payments when due under 11 AAC 04.030.

(b) For the purposes of determining whether to charge an administrative fee under this section, for a royalty report submitted under 11 AAC 04.040, each schedule and attachment included in the royalty report that is required to clearly present the facts of production, valuation, costs, or other payments associated with the accounting unit for which the royalty report is submitted is considered a separate report.
