11 AAC 04.060. Refunds and credits

(a) If the commissioner determines that the lessee has made an overpayment, the division will make a refund of the amount of the overpayment by warrant or credit. The division will make a refund by warrant only upon request of the lessee and only if the refund amount is more than $500. A request for refund by warrant must include the amount requested, the applicable revised supporting documentation required under 11 AAC 04.040, and a summary of facts explaining why an overpayment was made and how it was calculated. The division will pay a royalty overpayment refund with interest as provided in 11 AAC 04.070.

(b) The division will, in its discretion, apply a refund to offset amounts owed by a lessee on any other royalties, bonuses, rents or other payments due the state.

(c) Notice of crediting of the overpayment will be made by approved electronic commerce method or in writing to the address specified in writing by the lessee to the division. Payment of the overpayment by warrant will be made to the address provided by the lessee. The lessee may change the address to which payments are to be directed by providing written notice to the division.
