Section 70. Collection of claims

8 AAC 27.070. Collection of claims

(a) When the commissioner takes an assignment from a person who has a claim against a fish processor or primary fish buyer under AS 16.10.290 (e), the commissioner will notify the fish processor or primary fish buyer of the claim, and furnish the fish processor or primary fish buyer with a copy of the assignment, a description of the alleged violation and the results of the division's investigation.

(b) The division will schedule an informal conference with the fish processor or primary fish buyer to attempt to collect the money due the claimant. If the informal conference succeeds in recovering the money due, no further action will be taken by the division. If the money is not collected through the informal conference, the commissioner will, in his discretion, refer the matter to the attorney general.
