Section 260. Changes in adoption or guardianship subsidy payment

7 AAC 53.260. Changes in adoption or guardianship subsidy payment

(a) If an adoptive parent or guardian requests a change in the subsidy amount before or after the adoption or guardianship is final, the department will negotiate the amount with the adoptive parent or guardian.

(b) Any adjustment in the monthly payment under (a) of this section must be based upon documented changes in the child's needs, or changes in the circumstances of the adoptive or guardianship family, and will be made only with the adoptive parent's or guardian's concurrence.

(c) A change in the maximum allowable subsidy payment due to an increase in foster care rates is not automatic, but will be based on the child's needs and the circumstances of the adoptive or guardianship family.

(d) The department may change a subsidy payment to reflect a decrease in foster care rates without the adoptive parent's or guardian's concurrence. The department will notify the adoptive parent or guardian in writing of a change in a subsidy payment that results from a decrease in foster care rates. The department will consider an adjustment to that change if requested by the adoptive parent or guardian. In the notice to the adoptive parent or guardian, the department will state that the change will take effect 15 days after the notice is received by the adoptive parent unless the adoptive parent requests a fair hearing under 7 AAC 53.265
