Section 475. Child-student earned income disregard

7 AAC 45.475. Child-student earned income disregard

(a) When calculating an assistance unit's total gross monthly income under 7 AAC 45.470(a) , the department will disregard the earned income of a dependent child who is a full-time or part-time student.

(b) In this section

(1) "full-time student" means a dependent child who is regularly attending

(A) vocational training that is designed to prepare a student for gainful employment, including participation in the Job Corps program established under 29 U.S.C. 2881 - 2901, for at least 30 hours a week if the program involves shop practices or at least 25 hours a week if the program does not involve shop practices;

(B) a college or university for at least 12 semester or quarter credit hours a semester or quarter;

(C) a high school for at least 25 hours a week or, if in a high school cooperative or apprenticeship training program, full-time as defined by that program; or

(D) an accredited correspondence course for at least 25 hours a week;

(2) "part-time student" means a dependent child who is regularly attending a school, college, university, or course of vocational training

(A) who is not a full-time student; and

(B) whose course of study equals at least one-half of the course of study for a full-time student enrolled in a similar educational or training program, rounding down if necessary;

(3) "regularly attending" means enrolled and attending courses or enrolled but absent because of official school vacation, illness, convalescence, or family emergency.
